Seddon v Oldham MBC (Adoption: Human Rights)

Lorraine Cavanagh acted for the Respondent, Oldham MBC, in the High Court of Justice Family Division in the Matter of the Human Rights Act 1998 and in the Matter of Child A.

For the first time in domestic law the court has decided that an adoption order extinguishes the Article 8 rights between a child and a birth parent. Section 51A of the Adoption and Children Act 2002 is not incompatible with the Human Rights Act 1998 and the applicable law for leave applications under the Children Act have been applied to post adoption contact under the new provisions of the Adoption and Children Act. In this Human Rights claim Mr Justice Peter Jackson gave guidance on the obligations upon an adoption agency when administering a post adoption contact letterbox scheme.
