Re K-L (The Children)
The judgment has been released in the case of Re K-L. Karl Rowley QC led Leona Harrison acting for the Appellant.
The Judge initially gave an oral judgment making serious findings of sexual and physical abuse against the father. Later written judgment failed to reflect the earlier findings or recognise the change in position in exonerating the father in relation to the allegations of sexual abuse. Thereafter the Judge gave no cogent reasons in her third judgement on the point, notwithstanding being asked to do so by Counsel for the Mother. Court of Appeal found this and other failures within the judgment were so significant that the whole matter needed to be considered afresh and allowed the Appeal.
