Re A and B (Children: Transfer of Proceedings to Romania)
Kate Spence represented a local authority in a case concerning the abduction of children from the UK to Romania whilst subject to interim care orders. The local authority applied under Article 8 of the 1996 Hague Convention for Romania to be invited to accept a transfer of proceedings to enable the Romanian Authorities to assume jurisdiction in relation to the subject children.
Following a series of hearings, the local authority’s application was granted and the Romanian courts were invited to accept jurisdiction.
