R v W: James Hudson Secures Acquittal in Rape Trial

W, then aged 36, was alleged to have raped a 15-year-old girl (who was in the care of the Local Authority) at a hotel in Blackpool.

W denied any sexual activity took place.

The case involved consideration of a significant amount of unused material which revealed that a previous false complaint of rape had been made which involved the use of violence, which appeared to be similar to the allegation made in the present case. An application to adduce this evidence was made and granted.

Further, a number of important inconsistencies were discovered which provided an alternative explanation as to why the Complainant had turned her phone off, and why they were only in the hotel room for a short period before leaving.

Following a five-day trial at Liverpool Crown Court, W was acquitted by the Jury and maintains his good character.
