Joshua Daley makes a successful submission of no case to answer at Manchester Crown Court.

The Defendant was charged with one count of non-domestic burglary, which hinged on a single police officer’s purported identification of the Defendant on CCTV. One week after delivering his seminar on PACE S.78 applications, Josh made a successful S.78 application to exclude this evidence, predicated on the officer’s numerous failures to comply with PACE Code D, in accordance with the ratio in R v JD [2012] EWCA Crim 2637. A successful submission of no case to answer followed, and the jury were directed to return a not guilty verdict.
