Rebecca Penfold successfully defended two clients facing multiple allegations of assault on emergency worker (police officers) before Manchester Crown Court. Rebecca argued that the Police had unlawfully entered the family home, in breach of PACE. The CPS did not resist the application to dismiss, offering no evidence on all counts. It was noted that the accounts in the Police witness statements were not supported by defence video footage, and that the defendants had the right to take action to end the trespass and respond proportionately to the assault and false imprisonment that they were unlawfully subject to by the Police. One defendant has suffered ‘life changing’ injuries and Police complaint proceedings are ongoing before the IOPC.
