Philip Grundy secures £1m settlement at JSM

Philip Grundy recently settled a claim at a JSM for £1,127,919.16 gross (£1m net to the Claimant) after 25% reduction.

The claimant suffered a major left-sided stroke due to the defendant’s negligence in 2015, when she was aged 30 and pregnant. She subsequently gave birth to a healthy child.

She suffered moderately severe brain dysfunction as a result of the stroke but was able to continue working albeit at a lower level than previously. Her life expectancy was not affected. She does require help with certain every day activities including needing some care, domestic support and services together with funds for home and vehicle adaptions, physiotherapy, orthotics and therapy.

Breach of duty and causation, causation in particular being in issue, was compromised a couple of years ago 75:25 in the claimant’s favour to reflect the litigation risk. The claimant had capacity.
