Timothy has considerable Trial and Advisory experience in civil cases involving allegations of fraud including cases brought in Tort and Contract and mainly, by reason of the allegation raised, allocated to the multi track.
Personal Injury Claims arising from Road Traffic Accidents
Staged or contrived accidents
Experience on paper and at trial where allegations of this nature are raised by the Defendant. Often in support of allegations of fraud of this type, evidence is available to support the assertion that individuals in more than one vehicle are known to each other. More frequently, Facebook evidence is relied upon.
Accidents that did not occur as alleged or at all
Experience where either lay evidence or expert engineering evidence is adduced to support the assertion that accident did not occur at all or not as alleged.
Multiple Occupancy
Experience where there is a positive allegation or suspicion regarding the presence of a Claimant in a vehicle involved in an accident. Cases of this type often involve the disclosure of documents from social media such as Facebook to evidence connections between passengers alleged to have been on, for example public service vehicles and, whom claim not to be known to one another.
Personal Injury Claims Generally
Whether arising out of Road Traffic Accidents, Employer’s Liability or Public/Occupier’s Liability Claims, Timothy has considerable experience at trial in Defending Claims where there are concerns over the veracity of factual allegations including the cross examination of Claimants whose allegations can be challenged with the use of CCTV in order to challenge the mechanics of an accident or an allegation that injuries and losses claimed have been exaggerated. Often, the CCTV is covert.
