Rebecca is a specialist practitioner in clinical negligence, personal injury, inquests and the Court of Protection, with particular experience in cases involving issues that span these areas of practice.

Clinical negligence

In her clinical negligence practice, Rebecca acts for Claimants and Defendants with a particular focus on fatal, maternity and paediatric cases. She is frequently instructed to represent bereaved families at inquests, including in Article 2 cases, and in related civil claims involving complex medical causation and delays in diagnosis or treatment. She has particular experience in stillbirth and birth injury claims where she combines clear analysis of complex medical evidence with a sensitive approach to these challenging cases.

Her practice encompasses cases involving psychiatric injury and treatment, often concerning vulnerable or protected parties, drawing on her parallel expertise in mental capacity law.

Rebecca also has experience acting for NHS Resolution, NHS Trusts, care homes and private medical practitioners. She has experience at mediation for both Claimants and Defendants.

Recent cases include:

  • LB v B NHS FT: Acted for the Claimant in stillbirth claim pleaded in excess of £750,000.
  • B v WH NHS FT: Acted for the Claimant executor in a fatal angiography delay case, including a protected beneficiary dependency claim.
  • CH v SHK NHS FT: Acted for the Defendant Trust in a breast cancer misdiagnosis claim, causation was denied.
  • W v SH: Acted for the Defendant nurse practitioner in a multi-defendant cancer claim which was discontinued after service of the Defence.
  • P v SH NHS FT: Acted for the Defendant Trust in psychiatric injury claim following stillbirth; the case settled at mediation significantly below the pleaded value.
  • LK v SWAS: Acted for family at inquest arising from missed diagnosis of fatal epiglottitis; the coroner found avoidable death with systemic failings. A civil claim is ongoing.

Inquests & coronial

Rebecca has a well-established inquest practice, regularly appearing in Article 2 and jury inquests. She has experience acting for bereaved families, NHS Trusts, care agencies and other public bodies.

She is recognised for her ability to handle the most sensitive cases with compassion and clarity, particularly deaths involving psychiatric patients, children, and following systemic failings in care. Rebecca brings her clinical negligence and Court of Protection experience to her inquest practice. She has a particular expertise in dealing with cases involving vulnerable people and those where there may be issues over capacity or mental health care and treatment.

Recent cases include:

  • Re SC: Acted for the family in an Article 2 inquest into the self-inflicted death of a woman days after her discharge from a psychiatric hospital. The coroner returned a conclusion of misadventure and found that combined failures of the psychiatric inpatient team and community treatment team were contributory factors to her death.
  • Re RH: Acted for the family in an Article 2 inquest into a psychiatric patient who committed suicide with a plastic bag; the jury identified failings in risk assessment, record keeping and restricted item checks.
  • Re FH: Inquest into a 13-year-old’s self-inflicted death; the coroner identified deficiencies in the provision of CAMHS care and support.
  • Re CS: Acted for the family at inquest related to numerous hospital falls leading to death; a narrative conclusion with neglect was returned with a Regulation 28 report issued against the NHS Trust.
  • Re JM: Acted for the NHS Trust following a death which occurred after the deceased sustained a bowel injury during surgery. The coroner returned a narrative conclusion noting the death arose as a complication of necessary surgery.
  • Re KJ: Acted for the airport in a death arising from illicit drug smuggling.

Court of Protection

Rebecca is regularly instructed in health and welfare applications under s.15/16 and s.21A of the Mental Capacity Act 2005. She acts for local authorities, P (including through the Official Solicitor) and family members.

She is regularly instructed in contested capacity and best interests proceedings concerning residence, care, contact, capacity to engage in sexual relations and the urgent removal of P.

She has experience of complex Court of Protection proceedings, including:

  • Forced Marriage Protection Orders.
  • Closed material proceedings.
  • Fact-finding hearings into risk of abuse and contact arrangements.
  • Committal proceedings for breaches of injunctions.

She is frequently instructed in other jurisdictions specifically for her capacity expertise, including catastrophic injury cases and civil claims for unlawful deprivation of liberty. She also acts in cases with a civil cross-over, including damages claims under the Human Rights Act 1998.

Personal injury

Rebecca accepts instructions in areas of personal injury work with a focus on cases involving abuse, vulnerable or protected parties, and actions against public authorities. She is instructed in claims arising from historic abuse, “failure to remove” cases, and negligence in care settings.

She also has experience of appearing before the Criminal Injuries Compensation Tribunal, securing significant increases in awards for victims of serious assault and abuse.

Recent cases include:

  • KS v EUI: Acted for the Claimant in a seven figure catastrophic injury claim in which the Claimant suffered a traumatic brain injury. Instructed alongside senior counsel specifically in respect of contested mental capacity issues.
  • W v Ministry of Justice: Acted for the Claimant, a prisoner assaulted by fellow inmate with weapon.
  • Various Claimants v CCC: Acted for the Claimants in a historic abuse claim where the issue of an anonymity order post PMC v A Local Board was considered.
  • Re SM: Acted for the Claimant, a protected party, in an Article 5 HRA claim for unlawful deprivation of liberty which occurred over multiple years.
  • Re LD: Acted for the Claimant in a historic abuse claim related to sexual abuse perpetrated by a foster carer overseas.
