Personal Injury expert Matthew Mawdsley has written an article about a recent case regarding a highway claim. It addresses Smithson v (1) Lynn (2) North Yorkshire CC [2020] EWHC 2517 (QB) and addresses the issues of where the burden lies in showing ‘reasonable practicability’ under section 41 (A) of the Highways Act 1980, and what amounts to ‘reasonable practicability’.
