Laura Nash prosecuted Imtiaz Hussain, who pleaded guilty to breaching regulation 6(3) of the Work at Height Regulations 2005 and two counts of s22 of the Health and Safety at Work Act 1974. He was the person in control of the work at a construction site. Two prohibition notices were issued on the two scaffolds at the site due to missing guardrails and scaffold boards. Hussain failed to comply with the notices and failed to take suitable and sufficient measures to prevent falls from height during the roof work. He was sentenced to 8 months’ imprisonment suspended for 2 years with 200 hours of unpaid work and costs of £5,000.
