David Pojur succeeds on appeal to keep Hospital open
David Pojur represented a specialist hospital which provides continuous care for severely autistic patients.
The independent tribunal heard evidence that the CQC failed to justify its case to serve notices which would close the rare healthcare provider. The judgment was critical of the approach and evidence of the Commission, beginning “CQC has done more to lose this appeal than the Appellant has done to win it.”
Expert medical evidence was provided which demonstrated the significant beneficial impact investment in the hospital was having on patients. The Chairman of the Board confirmed spending of £250,000, with a budget of £650,000 for immediate improvements to dedicated apartments for patients.
The appeal against the CQC’s decision-making process and conclusion was upheld, meaning extremely vulnerable patients do not need to be removed from their apartments.
