Meadows v La Tasca

July 8, 2016

Sufiyan Rana successfully overturned a ruling of fundamental dishonesty and an order for the claimant to pay the defendant’s costs at Manchester County Court.

He acted on behalf of a claimant who alleged she was injured after slipping on the floor of a La Tasca restaurant. The judge at the first instance had found against the claimant in the main action and permitted the defendant’s application ruling the Claimant had been dishonest.

The claimant was faced with a liability for the defendant’s costs to the sum of £7,210.

An appeal was lodged on the basis that the judge had erred in concluding that the claim was fundamentally dishonest. Instructed by Express Solicitors, Mr Rana helped overturn the ruling and the costs order, and the appeal court ordered the defendant to pay the claimant’s costs of the appeal.

The case was covered in Claims Media News, in which James Maxey, the managing partner of Express Solicitors, highlighted a worrying tactic of defendants increasing alleging Fundamental Dishonesty when a claim is unsuccessful.
