M v M [2025] EWFC 509 (B)

In M v M [2025] EWFC 509 (B), Naomh Gallagher successfully represented Applicant Mother in sensitive private children proceedings to secure permission for mother to disclose to their children the fact of their father’s gender exploration. Mother had been bound by an interim prohibited steps order (‘PSO’) preventing her from disclosing the father’s gender exploration to the children pending further consideration. Mother applied to lift the PSO and for a specific issue order permitting her to make disclosure in the event father continued to refuse. This is the first reported case dealing with contested disclosure of a parent’s gender identity to their children. The case also considers the competing rights of the child and those of the parents, in particular Article 8 and Article 14 of the ECHR.
