Flight Delay Compensation Case Finds in Passenger’s Favour
District Judge Jenkinson today ruled against an airline’s application for stays, in a test case at Liverpool County Court which could ultimately benefit thousands of passengers with flight delay compensation claims.
In Allen v Jet2.com, the airline had made an application that the passenger’s compensation claim be put on hold pending the outcome of Dutch case van der Lans v KLM. Four other airlines (Thomas Cook, Ryanair, FlyBe, WizzAir) had made similar applications. The judge refused, saying Allen v Jet2 should go ahead.
Simon Murray, instructed by Bott & Co acted for the Claimant in Allen v Jet2.com and in Alexander Dombovitch v WizzAir Hungary Limited.
Henry Vanderpump, instructed by Hughes Walker, acted for the Claimant in Kelly Barnes v Ryanair.
