Crime Seminar: The Evolution of Non-Fatal Strangulation and Domestic Violence Orders

This event will feature two separate talks from Emma Swindell and Jessica Foster, and from Emily Calman, followed by drinks and nibbles.

- Emma Swindell & Jessica Foster, The Evolution of Non-Fatal Strangulation:
The offence of non-fatal strangulation was introduced as part of the Government’s Violence Against Women and Girls Strategy 2021 and came into force on 7 June 2022. Ever since, the criminal courts have become inundated with defendants being charged with the offence.
This seminar intends to provide an overview of the offence, common misconceptions about the law surrounding non-fatal strangulation, and recent developments since it came into force. We will also discuss how the approach to sentencing has changed since the Sentencing Council provided a sentencing guideline for this offence, overtaking the principles of the previous Court of Appeal judgment in R v Cook [2023] EWCA Crim 452.
- Emily Calman, Domestic Violence Orders:
A whistle-stop tour regarding the orders available to the police/prosecution in relation to domestic violence cases. Specific discussion will be had regarding orders applied for at the police station stage, in circumstances where there is no support from the Complainant.
