Downes v Ostrowicka – County Court (Norwich) [July 2026]

Daniel Kinnear represented the Defendant (a general dental practitioner indemnified by Dental Protection) in a two-day trial. The Claimant alleged that the Defendant failed to obtain informed consent to the provision of bridgework at three teeth. Liability was denied in its entirety and the Claimant’s case was dismissed.
The judgment serves as an important reminder to experts of the importance of understanding their CPR 35 duties as well as the legal tests, with the Judge raising various criticisms of the conduct of the Claimant’s expert witness.
