Finding of Deliberate Smothering of an Infant Set Aside on Appeal

Karl Rowley QC led Lorraine Cavanagh in defending a finding of fact that their client caused the death of a baby by smothering him with a pillow. They were successful in establishing that the abusive act of smothering did not occur nor did any other act of physical abuse of the deceased child. The local authority had failed to prove the case to the requisite standard.
