Paul is a specialist in advising on complex matrimonial finance and children matters.

As a family law barrister with over 20 years of experience, Paul has vast experience in representing clients on all aspects of the consequences of the breakdown of relationships (whether marriage or cohabitation) and often represents the same clients in disputes regarding finances and children.

Paul is known for his practical advice that seeks to minimise the financial cost, expense and stress of financial and children proceedings. His calm and measured approach is well regarded by solicitors and clients.

In addition to his work as a barrister, Paul also sits as a Deputy District Judge hearing cases in the Financial Remedy Court, Family Courts and Civil Courts.

Paul accepts instructions under the Direct Access scheme. This often includes representation at court but Paul also advises in writing and in conferences and provides advice as to practice and procedure and prospects of success of appealing orders.

Family finance

A substantial amount of Paul’s work is in financial remedies and he is regularly instructed in mid and high value financial remedy cases pre and post issue of proceedings. Paul represents clients at court, private FDRs and arbitration. These cases usually involve either one of more of the following:

  • Interim maintenance
  • Legal Service Payment Orders
  • Freezing orders
  • Nuptial settlements
  • Corporate interests
  • Cohabitation disputes under TLATA
  • Financial provision for children pursuant to Schedule 1 of the Children Act
  • Advice on variation and appeals.

Recent cases

  • Surgeon with international reputation living in Florida against a QC. Applications included financial remedy proceedings, Schedule 1 proceedings, LSPO, Interim maintenance, Hague Convention Proceedings.
  • Acted for elderly Intervenors in multi-generational farm dispute and successfully protected the farm for future generations after claims by the wife for an equal share and sale of the farm arising from a constructive trust/proprietary estoppel.
  • Acted for Wife in short childless marriage case in which all the assets were owned by the high net worth husband who resided in Spain and owned a company worth £50m. Standard of living was high and successfully negotiated large lump sum for the Wife. Applications included forum non conveniens, LSPO, Interim maintenance, Non-Court Dispute Resolution.

 

Children (Private Law)

Paul is hugely experienced in representing parents in children law disputes at first instance and on appeal in the following matters:

  • Child arrangements orders
  • Prohibited steps orders
  • Specific issue orders
  • Injunctions
  • Removal from the jurisdiction
  • Internal relocation
  • Fact-finding hearings in domestic abuse cases
  • Cases involving Rule 16.4 guardians.

Notable cases

  • AC v NC [2021] EWHC 946. Represented mother in a Hague Convention proceedings before Mr Justice Mostyn in successfully opposing father’s application to have the child returned to the USA on the basis of an allegation that the Mother breached an order for contact with the father made in the USA.
  • Re F (A Minor] 2016. Representation of the Child in a matter before Mr Justice Hayden at the RCJ where it was alleged that a consultant clinical psychologist had fabricated quotations and documentation after the mother had recorded their sessions. Hayden J concluded that the Doctor’s evidence could not be relied upon and a new report was ordered. Led by Jonathan Cohen QC.

Recent cases

  • Acted for Father in children act proceedings in which the Mother had made serious allegations of rape, sexual assault and coercive and controlling behaviour. No finding were made after a finding of fact hearing and shared care ordered.
