AXA v BYB (QLR: Financial Remedies)

Naomh Gallagher successfully represented an applicant as a Qualified Legal Representative in a complex financial remedies case involving undisclosed proceeds of sale from an international property, with findings of dishonesty made against the respondent and the computation of this asset into the matrimonial pot. The applicant was a vulnerable witness due to cross allegations of domestic abuse.
The judgment is the first reported decision involving the new Qualified Legal Representatives introduced by the Domestic Abuse Act 2021. It is also the first example of QLRs being used in financial remedy proceedings at the Central Family Court.
