Approval for brain injury settlement by HHJ Evans – £367,000

Henry Vanderpump instructed by Samira Akbar of LPS Solicitors had settlement approved this week by the High Court. The Claimant suffered a moderate to severe brain injury but was not prepared to accept significant agency care or rehabilitation treatment. In addition, she had a short life expectancy from various comorbidities.
The case was complicated when the Claimant suffered a stroke unrelated to the accident as the parties entered settlement discussions.
The insurer, Ageas, offered extensive funding via the rehabilitation code enabling the case to be settled with limited medicolegal evidence.
This case is a model example of Claimants working collaboratively with insurers to reach a swift settlement at limited cost.
