A Hospital Trust v P & Ors

Lorraine Cavanagh KC led Lauren Maires for the local authority in a tragic case concerning a two-year old girl. The issue was whether life-sustaining treatment should be withdrawn.

Whilst she was at home, P suffered serious head injury and never regained consciousness. The prognosis was that her condition would continue to deteriorate and despite life support she would eventually die.

The hospital trust made an application for declarations pursuant to the inherent jurisdiction of the High Court that it was not in P’s best interests for life-sustaining medical treatment to be continued and it was in her best interests for a palliative care regime to be implemented. Ms Justice Knowles granted the application.
