£1 million brain injury settlement

Henry Vanderpump, instructed by John Bennett and Michelle Kemp of Forbes Solicitors, achieved settlement of a complex brain injury claim arising from a road traffic accident.

The Claimant sustained skull fractures, intracranial haemorrhage, a frontal lobe contusion and multiple orthopaedic injuries. The valuation of the claim was complicated by pre-existing learning difficulties, together with issues concerning the extent of any accident-related deterioration, epilepsy, capacity, future care needs, the balance between family and commercial support, and the Claimant’s long-term trajectory for potential independent living in the community, including whether sheltered or supported accommodation would be required.

The parties worked collaboratively throughout, securing interim funding for support and treatment. Settlement was achieved at JSM for £1,000,000 without the need for proceedings or further expert joint statement evidence.

The compromise was approved by HHJ Malek sitting as a Judge of the High Court in Manchester.
