Kelly is a junior common law barrister.

Kelly joined Chambers after successfully completing a pupillage under the supervision of Penelope Stanistreet and Gordon Stables.

Personal injury

Kelly appears on behalf of Claimants and Defendants across a broad spectrum of Personal Injury claims. Kelly is also frequently instructed to appear in claims involving credit hire disputes.

Kelly attends Application Hearings, Infant Settlement Hearings, Stage 3 MOJ Hearings, Small Claims Hearings, CMCs, CCMCs, Disposal Hearings, Fast Track trials, and Multi-Track trials.

Cases

  • Instructed to act on behalf of the Defendant in a road traffic accident claim concerning LVI. During the course of cross-examination of the Claimant, the matter was stood down so further instructions could be taken. A favourable outcome was achieved for the Defendant.
  • Instructed to act for the Claimant in a road traffic accident claim with allegations of fraud. A favourable settlement was negotiated at the door of court.
  • Instructed on behalf of a Claimant who had been seriously assaulted. The Claimant was awarded aggravated damages.
  • Instructed to act for the Defendant in a credit hire claim. The claim was dismissed in its entirety on the grounds that the Judge was not satisfied in relation to need or enforceability.

Kelly also receives instructions to draft pleadings and advise on quantum.

Inquests & coronial

Kelly has a keen interest in coronial law and is keen to develop this area of her practice further.

Kelly has appeared at Pre-Inquest Reviews.

Court of Protection

Kelly has considerable experience in drafting Statements of Facts and Grounds and initial orders in applications under section 21A of the Mental Capacity Act 2005.

Kelly is frequently instructed in applications brought pursuant to s15, s16, and s21A of the Mental Capacity Act 2005.

Cases

  • Instructed to act on behalf of P at a final hearing, at which the social worker’s conclusions were challenged.
  • Instructed to act for a family member who had made an application to alter P’s package of care. The application was opposed by a number of other family members. Trial of altered package of care ordered.
  • Instructed to advise on potential remedies following an unlawful deprivation of liberty.
  • Instructed to act for a Local Authority in an urgent s16 MCA 2005 application, which was heard without notice to any other party.

Public & administrative law

Kelly has appeared in the Mental Health Tribunal, acting on behalf of the patient.
