Quilter v Hodson Developments Ltd

The Supreme Court have refused permission to appeal in the case of Quilter v Hodson Developments Ltd. Pepin Aslett, who was led by Clive Freedman QC in the Supreme Court proceedings, originally successfully acted for Ms Quilter alone in the Court of Appeal in November 2016.  The decision is an important one for property purchasers who suffer misrepresentations.

The Court of Appeal confirmed on appeal that Ms Quilter did not have to account for a profit she made upon later selling the property following a rise in the market, and could take that benefit in addition to damages for the difference in value at the date of purchase due to Hodson’s failure to disclose certain matters.
