Douglas Lloyd has successfully defended a male nurse charged with sexual misconduct. The client was cleared of all 10 allegations of sexual misconduct, following an 8 day hearing at the Nursing and Midwifery Council, involving 13 prosecution witnesses.
The NMC panel found no sexual motivation, and no malicious intent, also clearing the client of allegations that he had verbally abused patients and harassed a colleague.
The panel also found the client’s fitness to practise was not impaired by lack of competence, despite failing competency assessments set by the hospital. The panel were persuaded by Mr Lloyd’s submissions that there had been serious, unfair deficiencies in the competency assessments. Conditions of practice were imposed in regard to lesser admitted charges, ensuring the client can continue to practise.
The client later wrote to his solicitors, to praise Mr Lloyd’s “unbelievable commitment”, “meticulous preparation” and “expert handling of witnesses”, praising Mr Lloyd as “everything you could want from an advocate”.
